Information we collect
We collect account credentials; name, mailing address, email address, and phone number; whether the account holder is a property owner or professional; the address of the property at issue; your description of the problem; follow-up answers; and files you choose to upload, including documents, photographs, and video. We also maintain technical records needed to secure and operate the service.
How information is used
Information is used to create and secure your account, organize a potential construction defect matter, assign Bates identifiers, generate source-linked summaries and timelines, identify follow-up questions, prepare reports and presentations, and allow a prospective attorney to review materials that you approve for sharing.
Automated analysis
When automated analysis is enabled, uploaded files and relevant property context may be transmitted to OpenAI through its business API for processing. High-volume uploads are retained in a private processing queue so they can be analyzed after upload without requiring the browser to remain open. AI output can be inaccurate. MyDefectCase is designed to ask you to confirm important identities, dates, image descriptions, and factual propositions before they are treated as confirmed. Remote analysis files are deleted after processing unless the operator intentionally enables retention.
Property map services
Property addresses may be sent to OpenStreetMap's Nominatim service to support private map context. If you later choose to open a property map, that third-party service receives the address search terms and applies its own privacy practices. The intake confirmation screen displays the property information you entered and does not perform party research.
Sharing and publication
Your private workspace is account-gated. A case presentation becomes accessible only after you publish it, and it may include the case contact, property information, evidence-derived people and organizations, and only the files selected for presentation. Information about a potential defendant appears only when it is part of text the user or approved evidence supplies. You may require a passkey or unpublish the presentation, but anyone with the active link and any required passkey may be able to view the approved material, so share both carefully. Submitting information does not create an attorney-client relationship or guarantee representation.
Retention and security
Information is retained while needed to provide the service, evaluate a potential matter, meet legal obligations, resolve disputes, and maintain security. Administrative, technical, and physical safeguards are used, but no system can guarantee absolute security. The operator should establish matter-specific retention and deletion periods before broad public use.
Your choices
You may choose not to publish a presentation, may unpublish it later, may require or remove a passkey, and may limit which evidence appears in it. To request access, correction, export, or deletion of your information, contact privacy@mydefectcase.com. Some records may need to be retained where required by law or legitimate security needs.
Children and changes
The service is not directed to children under 18. This notice may change as the platform, service providers, or legal requirements evolve; the effective date above will be updated when material changes are made.
